The Honduran People under a Permanent Coup d’Etat

Articulo en español abajo: By OFRANEH: The latest Coup d’Etat perpetrated in the early hours of December 12 in Honduras, when the National Congress voted to remove four Supreme Court justices, places front and center once again the dictatorship the country has experienced since June 28, 2009.  The ultra-right of Honduras has been offering up to us for the last three years lessons on their cannibalistic practices.

The local reality is macabre:  Honduras is considered the most violent country in the world with 92 assassination for each 100,000 inhabitants, and at the same time Honduras was the country most impacted by climate change between 1991 and 2010, and to add to these woes, is also the second poorest country in the hemisphere.  In the meantime, the elite in power is dedicated to the destruction of this weakened democracy to maintain their privilege at any cost.

Leading up to the action taken by the Congress which was pushed through by the majority from the National Party, the current “head of state”  Pepe Lobo denounced a supposed Coup d’Etat cooked up by Jorge Canhuati Larach, owner of various media outlets that are members of the Inter American Press Society (IPS), which recently conferred to him (Jorge Canhuati) an honorific mention in the category of “Human Rights and service to the community.”

As with Canahuati Larach, along with Pepe Lobo and the illustrative crowd of representatives that demolished the Constitutional Court, they were all implicated in the Coup d’ Etat of 2009.  Of course the Supreme Court participated fully in the gutting of democracy in 2009, which was categorized by the Library of Congress in the U.S. as a “Constitutional Succession.”

From Charter Cities to the Application of the Polygraph test:

The Constitutional Court came to be questioned, as with the rest of the Supreme Court, by the Executive and Legislative branches, after having declared unconstitutional the Law of Special Development Regions (RED), alias Charter Cities, a project cut from neocolonial cloth, that was intended to auction off slices of Honduran territory to U.S. investors known as libertarians and ultra-right.  Among other issues, the RED included transferring the application of justice to third parties, located on the island of Mauritius and finally the British Court of appeals.   

The furious reaction to the Supreme Court’s decision on Charter Cities, by Pepe Lobo and his protegé Juan Orlando Hernández, President of the Congress and candidate picked to be the future president of Honduras, demonstrated that the independence of the branches of government in Honduras finds itself under attack.

The situation was worsened even more, when the Constitutional Court declared unconstitutional the Law of Purification of the Police, which included psycho-metric, socio-economic, toxicological and polygraph tests, with this last test being questioned as a method that violates national laws as well as international human rights treaties.

The collapse of the National Police, with its absolute corruption and association with organized crime has the country in a sorry state, living under the yoke of security organisms that are implicated in multiple assassinations and sales of weapon arsenals.  The so-called “purification” of the police initiated about a year ago has not generated measureable results, and has aggravated the situation with the suspension of aid to the police by the U.S., surrounding evidence about Juan Carlos Bonilla, current director of the police, who was named in having participated in death squads from 1998 to 2002.

When the Constitutional Court voted four to one as to the unconstitutionality of the Law of Purification of Police, the same episode occurred as following the Charter City decision, where the judge Oscar Chinchilla took the side of the Legislative branch.  Despite Chinchilla having said that the use of the polygraph test was a violation of fundamental rights, he did not vote for unconstitutionality emitted by the majority of the Court.  Lacking a unanimous decision in the Constitutional Court, the plenary of the Supreme Court would meet to take a final decision.  Just hours before the Supreme Court plenary was to meet to consider the matter, the National Congress removed the four magistrates who had voted against the law in the Constitutional Court.

From electoral fraud to the suit filed about the vote counts

Last November 18 the primary elections took place in Honduras, to choose the candidates for president, congress and mayors.  As it is common knowledge, there was a shameful fraud committed, especially by the National Party, who are currently in power and have an absolute majority in the National Congress.

The two ultra-right candidates who ran for the highest positions of the National Party both claimed to have received the majority of the votes.  Finally the Supreme Electoral Tribunal (TSE) declared as winner Juan Orlando Hernández, current president of the National Congress, despite the statements by the supposed loser, Ricardo Alvarez, who was early on leading in the vote count before the ¨system crashed¨, leaving him behind.

The same story of fraud was repeated in the other traditional party that took part in the elections, the Liberals picked Mauricio Villeda Bermúdez, open admirer of the Colombian Alvaro Uribe and one of those integrated into the de facto government by dictator Roberto Micheletti.  The Supreme Electoral Tribunal indicated that these political parties worked to inflate the vote at the voting stations, while Ricardo Alvarez said there were members of organized crime making threats at the polls.

The political conditions in which the primary elections took place in the country served as a perfect stew for the electoral fraud, in that way maintaining the gang of coup-backers who find themselves clinging to power.  The famous Cartagena Agreement in the final analysis does not guarantee electoral transparency and much less strengthens the human rights of the Honduran people, who finds themselves subject to the violence of a feudal regime.

The gutting of the Constitutional Court of the Supreme Court is associated not only with their rejection of the Charter City law and the Law of Purification of the Police, but was also a strategy to derail in advance the claim presented by Ricardo Alvarez regarding the vote count, in the face of the evident fraud committed.

Of course, though the current boxing match is among groups of power associated with the ultra-right, this is still electoral fraud, and that it could be repeated next year during the presidential elections.

In Honduras the supposed liberal bourgeois democracy that exists is no more than a mask of a dictatorship of a small group of financiers, many of whom are associated with organized crime and protected by the empire, which is disposed to provide their blessing to those who would preserve the status quo.

The legislative coup against the Judiciary is openly associated with the recent electoral fraud and the impeding of  the auctioning off of Honduras by means of Charter Cities, which by the way President Lobo has said he will implement anyway, if not during this term, then in the next one.

Honduras: Pueblo hondureño bajo un Golpe de Estado Permanent

El nuevo Golpe de Estado perpetrado en la madrugada del 12 de diciembre  en Honduras, cuando el Congreso Nacional procedió a destituir cuatro magistrados de la Corte Suprema de Justicia, saca a flote una vez más la dictadura que se vive en el país a partir del 28 de junio del 2009.  La ultraderecha hondureña nos viene brindado en los últimos tres años una lección una de sus prácticas de canibalismo.

El escenario local es macabro: Honduras es considerado el país mas violento del mundo con 92 asesinatos por cada cien mil habitantes, al mismo tiempo es el país mas afectado por el cambio climático entre 1991 al 2010, y para colmo de males es el mas pobre del continente. Mientras tanto, la élite de poder se dedica a la destrucción de la endeble democracia para mantener sus privilegios a toda costa.

Como anticipo a la acción tomada por el Congreso en su mayoría de afiliación nacionalista, el actual “mandatario” Pepe Lobo denunció un supuesto Golpe de Estado fraguado por Jorge Canahuati Larach, propietario de varios medios de comunicación y miembros de la Sociedad Interamericana de Prensa (SIP), la que hace poco le confirió una mención honorífica por la categoría de “Derechos Humanos y servicio a la comunidad”.

Tanto Canahuati Larach, como Pepe Lobo y la ilustre caterva de diputados que demolieron la sala de lo Constitucional, estuvieron implicados en el Golpe de Estado del año 2009. Por supuesto que la Corte Suprema participó de lleno en la defenestración de la democracia en el año 2009, que fue rotulada por la Biblioteca del Congreso de los Estados Unidos como “Sucesión Constitucional”.

De las Ciudades Modelo a la  aplicación del polígrafo 

La Sala de los Constitucional pasó a ser cuestionada, al igual que el resto de la Corte Suprema, por los poderes Ejecutivo y Legislativo, al dictaminar inconstitucional la Ley de Regiones Especiales de Desarrollo (RED), alias Ciudades Modelos, proyecto de corte neocolonial, que pretendió subastar franjas del territorio hondureño a inversionistas estadounidenses reconocidos como libertarios de ultraderecha. Entre otras las RED incluía una tercerización de la aplicación de justicia dentro de las ciudades modelo, las que utilizarían a  a la isla de Mauricio y finalmente a la Corte Británica para las apelaciones.

La furiosa reacción ante el dictamen de la Corte Suprema sobre las RED, por parte de Pepe Lobo y su delfín Juan Orlando Hernandez, Presidente del Congreso Nacional y candidato ungido como futuro presidente de Honduras, demostró que la independencia de poderes en Honduras se encuentra en tela de juicio.

La situación se agravó aun más, cuando la Sala de lo Constitucional declaró inconstitucional la Ley de Depuración de la Policía, la que incluye pruebas psicométricas, socioeconómica, toxicológica y del polígrafo, siendo este último cuestionado método que vulnera tanto las leyes nacionales, como tratados internacionales de derechos humanos.

El colapso de la Policía Nacional, ante su corrupción absoluta y asociación con el crimen organizado, tiene en vilo al país, que vive bajo la férula de los organismos de seguridad, implicados en múltiples asesinatos y ventas de arsenales. La supuesta depuración de la policía  iniciada aproximadamente hace un año no ha generado efectos contundentes, agravándose la situación por la suspensión de la ayuda a ese organismo por parte de los Estados Unidos, tras los señalamientos que existen sobre Juan Carlos Bonilla, actual director de esa institución, señalado por haber participado en los escuadrones de la muerte entre 1998 y el 2002.

Al pronunciarse la Sala de lo Constitucional por cuatro votos en contra de uno, sobre la inconstitucionalidad de la Ley de Depuración de la Policía, se repitió el mismo episodio de la Ley RED, donde el magistrado Oscar Chinchilla tomó partido por las leyes emitidas por el Poder Legislativo. A pesar que Chinchilla señaló como violación a los derechos fundamentales la utilización del polígrafo, no se plegó al fallo de inconstitucionalidad emitido por la mayoría de la Sala. Ante la ausencia de una votación unánime al respecto, el pleno de la Corte Suprema sería el encargado del dictamen final. Horas antes que se reuniera La Corte para definir sobre el  el Recurso de inconstitucionalidad, el Congreso Nacional remueve a los magistrados que fallaron en contra de la Ley de Depuración.

Del fraude electoral al recurso interpuesto para el  conteo de  los votos.

El pasado 18 de noviembre se efectuaron las elecciones primarias en Honduras, para escoger los candidatos a la presidencia, congreso y alcaldías. Como es de conocimiento publico se dio un fraude vergonzoso, especialmente entre el Partido Nacional, el que actualmente se encuentra en el poder, y posee una mayoría absoluta en el Congreso Nacional.

Los dos candidatos de ultraderecha postulados por las cúpulas del Partido Nacional aducen haber logrado la mayoría de votos. Finalmente el Tribunal Supremo Electoral (TSE) declaró como ganador a Juan Orlando Hernández, actual presidente del Congreso Nacional , a pesar de los señalamientos del supuesto perdedor, Ricardo Alvarez, el cual en un inicio llevaba la delantera en el conteo y tras una “caída del sistema” , quedó rezagado.

La misma historia de fraude se repitió en el otro partido tradicional que concurrió a elecciones, los liberales ungieron a Mauricio Villeda Bermúdez, manifiesto admirador del colombiano Alvaro Uribe y uno de los integrantes del gobierno de facto manejado por el dictador Roberto Micheletti. El TSE señaló que los partidos políticos se encargaron de inflar los votos en las mesas, mientras Ricardo Alvarez indicó la presencia y amenazas de miembros del crimen organizado en las mesas electorales.

Las condiciones políticas en que se efectuaron las elecciones primarias en el país, sirvieron como el perfecto caldo de cultivo para un fraude electoral, y así mantener la pandilla de golpistas que se encuentran incrustados en el poder. El tan famoso Acuerdo de Cartagena, al final de cuentas no garantizó ninguna transparencia en las elecciones y mucho menos fortaleció a los derechos humanos del pueblo hondureño, el que se encuentra sometido a la violencia por un régimen feudal.

La defenestración de la Sala Constitucional de la Corte Suprema, esta asociada no solamente al rechazo de la misma a la Ley RED y la Ley de Depuración de la Policía, sino que es una estrategia para frenar de antemano el  recurso presentado por Ricardo Alvarez para un conteo de los votos, ante el evidente fraude cometido.

Por supuesto que el pugilato actual es entre grupos de poder asociados a la ultraderecha, pero no deja de ser un fraude electoral, el cual es evidente que se repetirá el próximo año en las elecciones presidenciales. En Honduras la supuesta democracia liberal burguesa que existe en el país no es más que una máscara de la dictadura de grupúsculos financieros, muchos de ellos asociados con el crimen organizado y protegidos por el imperio, el cual se destaca por otorgar su beneplácito a aquellos que preconizan el status quo.

El golpe del legislativo al Judicial, está  abiertamente asociado con el reciente  fraude  electoral y el freno a la jugosa subasta de Honduras bajo el marco de las ciudades modelo, que de pasó ya indicó el Lobo se implementarán  sino en este gobierno, en el próximo.
